Cooling-off (right to cancel within 14 days)
Rule - Under the Consumer Contracts Regulations 2013 you have 14 days to withdraw from a credit agreement started online or off-premises, counting from the day you receive your card. If you withdraw you must repay any outstanding balance but the cardmembership fee for initial, joining or supplementary cards will be refunded for that period according to Amex terms.
Required proof - copy of card receipt or delivery date; written notice of withdrawal (email, secure message or registered letter).
Applicable law - Consumer Contracts Regulations 2013.
Price increase or change in card benefits
Rule - If American Express increases fees or reduces benefits and the change entitles cardholders to cancel under the card terms, you may cancel and ask for a pro-rata refund of cardmembership fees for the remaining period. Amex states it will refund fees pro-rata when it switches you to a different card tier.
Required proof - copy of Amex notification of fee increase or product change; account statement showing fee charged.
Applicable law - Consumer Rights Act 2015 for unfair terms; check your card terms for contractual rights.
Death of the cardholder
Rule - On death the executor or administrator should notify American Express to close the account and settle or transfer the outstanding balance according to the estate rules.
Required proof - death certificate; probate or estate administration documents; executor identification.
Applicable law - Standard estate administration and the card terms.
Legitimate grounds and dispute-based cancellations
Rule - Legitimate grounds accepted by Amex for closing or disputing transactions include faulty merchant performance eligible under Consumer Rights Act 2015 or a complaint found in your favour by the Financial Ombudsman Service. The Financial Ombudsman decision in case DRN-5036981 documents disputes over cancellation and refund claims.
Required proof - merchant receipts, correspondence with merchant, Financial Ombudsman decisions, account statements.
Applicable law - Consumer Rights Act 2015; Financial Ombudsman Service procedures.
End of commitment
Rule - Most American Express cards do not have a fixed minimum commitment; you can close your account. If an annual cardmembership fee was charged and you cancel mid-year, Amex may refund a pro-rata portion if terms allow or if you upgrade/downgrade card tier.
Required proof - account statement showing payment date and any confirmation of upgrade/downgrade.
Applicable law - See your card terms and the Consumer Credit Act 1974 for regulated credit agreements.
